CONDITIONS OF USE
These Conditions of Use govern your use of the Agency for Integrated Care’s (“AIC”) Community Care LMS (Learning Management System).
In these Conditions of Use, “you” and “your” refers to any person and/or organisation who are users of the Community Care LMS.
These Conditions of Use can be revised at any time without notice to you. Any changes to these Conditions of Use shall take effect immediately and your continued use of the Community Care LMS will be deemed to constitute acceptance of the revised Conditions of Use. It is your responsibility to check the

for such changes from time to time. If you do not agree with these Conditions of Use, please do not access or use the Community Care LMS.
Any information or features that form part of the Community Care LMS can be modified or discontinued at any time, without notice to you and without liability.
USER ACCOUNT REGISTRATION
To register for a user account, you may be required to provide us with personal data (such as your name, NRIC, mobile number and email address) in accordance with instructions given through the Community Care LMS.
In requesting for AIC to provide you with a user account or registering for a user account, you represent and warrant that:
all registration details
, including personal data,
provided by you is true, accurate, current and complete to the best of your knowledge and belief; and
you will promptly update AIC of any change to your registration details.
You must keep your user account ID and password confidential and shall allow no other person or entity to use the user account. You must notify us immediately if you have any reason to believe that the security of your user account has been compromised.
You acknowledge and agree that AIC and its employees, officers, directors, affiliates, partners, associates, agents and subcontractors may access your user account and its contents as necessary for purposes including but not limited to identifying or resolving technical problems or responding to complaints without prior notice to you.
AIC reserves the right to reject your request for a user account or deny you access to the Community Care LMS without giving any reason.
YOUR USE OF THE COMMUNITY CARE LMS
You agree to be responsible for all matters arising from your use of the Community Care LMS and for any and all activities which occur under your user account. For the avoidance of doubt, in cases where you have allowed any other person to use your user account or have negligently or otherwise made your password publicly available, you recognise that you are fully responsible for:
the conduct of such user(s);
controlling the user’s access to and use of the Community Care LMS; and
the consequences of any use or misuse of the Community Care LMS.
You shall not to use the Community Care LMS in any manner which breaches any applicable law or regulation or which may cause an infringement of any third party rights;
You shall not to post, transmit or disseminate any information on or via the Community Care LMS which may be harmful, defamatory, illegal or create liability on AIC’s part;
You shall not to obtain or attempt to obtain unauthorized access, via whatever means, to any other user’s account or to any other information within the Community Care LMS which are not intended for you.
The information contained within or generated from the Community Care LMS is strictly confidential. You may not reproduce, republish, upload, post, transmit, or distribute in any way any material from the Community Care LMS without the prior written permission of AIC.
PERSONAL DATA PROTECTION
You shall:
comply with all of your obligations under the Personal Data Protection Act 2012 (“PDPA”) and/or any other applicable law relating to data privacy or confidentiality;
provide all information and co-operation regarding the processing, use and disclosure of a user’s personal data which you had obtained through the Community Care LMS which AIC may reasonably require in order to comply with AIC’s obligations under the PDPA;
only process, disclose or use the personal data obtained through the Community Care LMS strictly in accordance with and to the extent required for the purposes for which the personal data was made available to you; and
keep private and confidential, and not disclose personal data obtained through the Community Care LMS to any third party unless authorised by AIC in writing or unless consent has been sought from the person to whom the data relates.
If you upload personal data onto the Community Care LMS
, including personal data which you provide to us for the purposes of registering user account(s), you warrant that you have obtained the necessary consents from the person concerned (a) for AIC to use and/or disclose the personal data for the purposes set out in AIC’s Data Protection Policy (

) ; and (b)
for AIC, its service providers,
public healthcare institutions,
public agencies and government bodies to use and/or disclose the personal data for purposes contemplated by the Community Care LMS, including but not limited to:
providing services related to patient care, whether presently or in the future;
applying for applicable subsidies;
calculation of the subsidy amount;
carrying out research, planning and statistical analysis;
creating and managing user accounts for the Community Care LMS
; and
any other reasonable purposes related to the aforesaid.
You warrant that any personal data you upload to the Community Care LMS is accurate and complete. If you have obtained or received any personal data through the Community Care LMS, you shall put in place adequate measures to ensure that the personal data is accurate and complete. You shall take steps to correct such personal data in your control or possession, as soon as practicable upon receiving a request for correction from AIC or the person to whom the data relates. If you receive information that personal data in the Community Care LMS is inaccurate, you shall also take such steps as are necessary to update and correct the data residing in the Community Care LMS by following procedures within the Community Care LMS or as directed by AIC.
If you have obtained or received personal data through the Community Care LMS, you shall take appropriate security arrangements to prevent unauthorised or accidental access, collection, use, disclosure, copying, modification, disposal or destruction (or other similar risks) of the personal data in your control and possession.
You agree to use and process personal data obtained through the Community Care LMS only in Singapore and not to transfer the personal data outside Singapore.
You shall delete from your records and/or destroy a user’s personal data obtained from the Community Care LMS, and not keep any copies of the personal data in any form when there are no legitimate legal or business purposes for retaining the personal data.
GENERAL DISCLAIMERS
You agree to use and access the Community Care LMS at your own risk. AIC does not represent or warrant that your use of the Community Care LMS will be uninterrupted or free from error or that the Community Care LMS will be free from viruses or other harmful components and AIC disclaim all liabilities in relation thereto.
You acknowledge that you have not relied upon any representation, warranty or other assurance and you waive all remedies which, but for this clause, might otherwise be available to you in respect of such representation, warranty or other assurance.
To the maximum extent permitted by the law, you agree that AIC and its officers, directors, shareholders, employees, agents and sub-contractors shall not be liable, in any circumstances whatsoever, for any loss of data, business, profits or goodwill, loss of use, interruption of business, or for any indirect, special, incidental or consequential damages of any character, even if AIC is aware of the risk of such damages, arising from or in connection with:
your access, use or inability to access the Community Care LMS;
any system, server, communication or connection failure;
any delays in operation or transmission;
the conduct of any person who accesses or uses or uploads any information in the Community Care LMS;
any computer virus; and/or
any omissions, inaccuracies, interruptions, defects or other problems with the Community Care LMS.
AIC’s liability to you in all cases relating to your use of the Community Care LMS shall not, for any reason, exceed Singapore Dollars 1,000. This limitation applies to all causes of action in the aggregate including, without limitation, breach of contract, breach of warranty, negligence, strict liability, misrepresentations and other torts.
You agree to indemnify AIC, its affiliated and related entities, and each of their respective officers, directors, shareholders, employees, agents and sub-contractors (collectively known as the “Indemnitees”) against all or any losses, claims, damages, statutory penalties, actions, proceedings, costs, claims, demands, liabilities (whether criminal or civil), settlements, expenses (including legal costs on an indemnity basis) which may be suffered or incurred by the Indemnitiees or asserted against the Indemnitees by any person, party, entity whatsoever, in respect of:
your unauthorised use of and access to the Community Care LMS;
your breach of these Conditions of Use; and.
the occurrence of any event due to your act, omission or default which comprises the security or integrity of the information in the Community Care LMS, including but not limited to users’ personal data.
TERMINATION OF USE
AIC reserves the right to terminate your user account immediately without prior notice, without giving you a reason and/or without further references to you if:
AIC (in its sole discretion) believes that you are in breach, or will be in breach, of any of these Conditions of Use;
your user account is inactive;
AIC deems fit to do so for security reasons or to protect AIC’s interests or the interests of other users of the Community Care LMS;
AIC discontinues the Community Care LMS; and/or
AIC is ordered by law enforcement or any governmental agencies to do so.
You shall notify AIC immediately when a person issued with a user account is no longer in your employment or no longer needs the user account, so that AIC may terminate the user account.
After termination, AIC may delete from the servers, any and all information contained in your user account.
GOVERNING LAW AND DISPUTE RESOLUTION
These Conditions of Use shall be governed by the laws of the Republic of Singapore.
You agree to submit to the jurisdiction of the courts of the Republic of Singapore and any dispute shall be referred to and finally settled by the courts of the Republic of Singapore.
